Privacy Policy
1.1 This Privacy Policy ("Privacy Regulations") has been issued by ARK Capital AG ("Website Operator").
1.2 This Privacy Policy forms the basis for the processing of personal data of users of the website or the online store ("Customers") and provides information about what type of user data is collected by the Website Operator, how the Website Operator uses this data, and what rights Customers have. The Website Operator complies with applicable data protection laws and processes personal data solely for the purposes for which the data was provided.
1.3 This Privacy Policy is updated, supplemented, or amended from time to time. The current version available at the time of accessing or visiting the website applies.
2.1 The term personal data as used in this Privacy Policy refers to information through which Customers can be personally identified. The processing of personal data includes any handling of personal data, such as collection, use, storage, disclosure, transmission, or deletion of data.
2.2 When visiting the website, statistical visitor data is automatically collected about which parts of the website offering were visited by the Customer. Each time a webpage is accessed, the web server automatically stores a so-called server logfile, which contains the name of the requested file, the Customer’s IP address, date and time of retrieval, the browser used, operating system, and the amount of data transmitted, and documents the retrieval.
This access data is evaluated solely for the purpose of ensuring the smooth operation of the site and improving the offer.
2.3 The Website Operator does not automatically collect personal data of Customers, such as name, address, phone number, or email address. However, personal data is collected when a Customer voluntarily provides it as part of an order or when contacting the Website Operator (e.g., via contact form or email). Mandatory fields are marked as such, as the Website Operator needs this data to process the contract or handle the inquiry, and without it, the order or inquiry cannot be sent. The data collected is evident from the respective input forms.
2.4 If a Customer decides to create a customer account, the Website Operator will use the personal data for the purpose of opening the customer account. The required fields during registration must be fully completed, otherwise, the Website Operator may reject the registration. The Website Operator uses the personal data collected solely for the purpose of using the online shop or the service or offer for which the Customer registered. Additionally, the Website Operator may use the Customer's email address to inform them about important changes, such as changes in the scope of offers or necessary technical updates.
2.5 After the contract has been fully processed or after the customer account has been deleted, the Customer’s data will be restricted for further processing and deleted after the legal retention periods, unless the Customer has expressly consented to further use of the data, or the Website Operator reserves the right to use the data beyond this, as permitted by law. The deletion of the customer account is possible at any time and can be done either by sending a message to the contact details below (see point 9.) or through the function provided in the customer account.
3.1 The legal basis for collecting and processing the Customer's personal data depends on the specific purpose of data processing. These may include:

4.1 The Website Operator uses Google Analytics. To deactivate Google Analytics, Customers can install a browser add-on available here: https://tools.google.com/dlpage/gaoptout
4.2 The Website Operator uses session cookies for the online shop, which are deleted after the browser session ends, i.e., after closing the web browser. Session cookies are a technical component of the shop functionality and do not contain personal data.
5.1 If a Customer wishes to subscribe to a newsletter offered by the Website Operator, the Website Operator needs the Customer’s email address and other information to verify that the Customer owns the provided email address and agrees to receive the newsletter (so-called double opt-in procedure). If a registered customer wishes to subscribe to the newsletter, they can give their consent during registration or later via the registration function in their customer account.
5.2 With the newsletter, the Customer regularly receives recommendations and offers that may interest them. For this purpose, the Website Operator collects and processes personal data regarding orders with the Website Operator and how the Customer uses the newsletter (e.g., whether the newsletter is opened). The Website Operator may evaluate this data for statistical purposes to better tailor the newsletter content to the interests of the Customer.
5.3 The processing of personal data entered into the newsletter registration form is based on the Customer’s consent, which can be revoked at any time for the future. The revocation can be made via the unsubscribe link in the newsletter, by written communication to the Website Operator at the contact details below (see point 9.), or by unsubscribing in the customer account. The personal data collected will be used by the Website Operator for the design and distribution of the newsletter. No data will be disclosed to third parties for their own (advertising) purposes.
6.1 The Website Operator will not disclose personal data of Customers to third parties unless the Customer has consented to the disclosure of data to companies not affiliated with the Website Operator, the disclosure is necessary to provide the products and services requested by the Customer, or the Website Operator is legally, administratively, or judicially required to do so.
7.1 The transmission of data over the Internet is not secure. The Website Operator collaborates with service providers and Internet providers who take appropriate technical and organizational security measures to protect the personal data of Customers. However, the Website Operator cannot guarantee the security of data transmitted by the Customer during transmission. Therefore, any data transmission is at the Customer's own risk.
8.1 The Customer may inform the Website Operator at any time that personal data should no longer be used for contact purposes. Participation in special services of the website, such as the newsletter service, can also be revoked at any time.
8.2 The Customer has the option to obtain information about data processing or request a copy of the personal data collected via the website.
